Title IX

Title IX of the Education Amendments of 1972 protects individuals from sex discrimination in educational programs and activities at institutions that receive federal financial assistance. Title IX states:

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance."

— Title IX of the Education Amendments of 1972, and its implementing regulation at 34 C.F.R. Part 106 (Title IX)

Kellogg Community College ("KCC") is committed to providing a workplace and educational environment, as well as other benefits, programs and activities that are free from sexual harassment, sexual misconduct and retaliation. Sexual harassment, which includes sexual assault, dating violence, domestic violence and stalking (as those offenses are defined in the Clery Act, 20 U.S.C. 1092(f) and the Violence Against Women Act, 34 U.S.C. 1229(a)) will not be tolerated and are expressly prohibited by KCC.

KCC also prohibits retaliation against any person participating in good faith in any investigation or complaint process internal or external to the institution; for bringing a complaint of harassment or misconduct; for assisting someone with such a complaint; or for attempting to stop harassment or misconduct.

New federal Title IX regulations were released in 2020 and are effective as of Aug. 14, 2020. To comply with these regulations, KCC modified its policy and grievance procedures. The policy is available here:

Responsible Employees

Responsible employees have the duty to bring forward any information regarding possible sexual harassment, sexual misconduct and/or retaliation by reporting it to the College's Title IX Coordinator(s) so that necessary and appropriate actions can be taken to respond appropriately. Therefore you may also report concerns to:

  • All instructors, including full-time professors, adjuncts and any others who offer classroom instruction or office hours to students
  • All Student Services staff
  • All coaches, trainers and other athletic staff that interact directly with students
  • Employees who work in campus offices
  • Public Safety (ext. 4444 or 269-965-4147 or at the desk in the walkway by Registration and Records between Student Services and the Ohm Building)
  • Human Resources (ext. 2369 or 269-965-4152)

Confidential Employees

Students may talk with a KCC counselor to seek assistance and support. Counselors are not required to report any information about an incident without a victim's permission.

Employees have a confidential reporting option with the College's Employee Assistance Program.

Requests for confidentiality may not be granted where state law or professional licensing mandates reporting in extreme cases of immediate threat or danger, imminent harm to self or others or abuse of a minor.
